We want our customers to be pleased with their purchases. If for any reason you have a problem or question, please email us at sean@commodorecoins.com. We will always do our best to accommodate you. Below are our terms and conditions and return policy. Please read these prior to making a purchase.

SECTION 1 – OVERVIEW

This website is operated by Commodore Coins & Collectibles, Ltd. Throughout the site, the terms “Commodore”, “we”, “us” and “our” refer to Commodore Coins & Collectibles, Ltd. We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated herein.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

By agreeing to these Terms of Service, you represent that you are at least 21 years of age. Shipment of merchandise will be made once funds are verified and cleared by our bank. We only accept payment in U.S. dollars.

SECTION 2 – PURCHASER’S ACKNOWLEDGEMENT AGREEMENT

Purchaser acknowledges receipt of the merchandise described from Commodore Coins & Collectibles, Ltd., hereinafter referred to as Commodore (commodorecoins.com) and partners and, by such receipt:

1).  assumes all responsibility and liability therefore, including but not limited to usage and storage of same;

2).  expressly agrees that Commodore or its partners assume any liability whatsoever under any applicable laws for its use, resale or safe handling under any applicable law or regulation;

3).  covenants not to institute legal proceedings of any kind against Commodore and/or partners concerning any injury, claim, demand, damage, right or cause, or action of any and every kind and nature arising out of any assertion of personal injury or property damage to Purchaser or to any other persons or property arising from purchase of the described merchandise and covenants to hold Commodore harmless from all damages, claims, actions, judgments, fees or costs of counsel which may arise or be in any manner asserted to arise from purchase or possession of the described merchandise;

4).  understands that all of Commodore’s and partners merchandise is sold solely as collector’s items, and is not warranted as functionally sound or safe, and that any firearm must be inspected by a licensed gunsmith before firing.  Items of recent manufacturer may be covered by a warranty from the manufacturer but are in no circumstances warranted in any respect by Commodore and/or its partners.

SECTION 3 – DESCRIPTIONS AND GRADING

Purchaser acknowledges that all grading of merchandise sold by Commodore Coins & Collectibles, Ltd. and/or our partners have been determined by independent grading services, and/or by us. Purchaser acknowledges that the grading of antique Arms and Armor and all collectible tangible assets are subjective and accordingly may differ among independent grading services, antique dealers and estate or auction appraisers of collectible tangible assets and that such grading may have a material effect on the ultimate value of the merchandise.

There can be no claim that any verbal description of the merchandise, provided by us and /or partners, varies and/or alters the description contained on the web site.  All merchandise is unconditionally guaranteed genuine or your money back.

SECTION 4 – CERTIFIED COINS

No returns will be accepted for coins that are certified by any third-party numismatic grading service, including but not limited to PCGS, NGC, ANACS, or other reputable coin authentication and grading services based in the U.S. All sales of certified coins are final. In the event a certified coin is later determined to be counterfeit, purchaser must deal directly with the grading service that authenticated the coin for resolution of any dispute.

SECTION 5 – UNCERTIFIED COINS GUARANTEE OF AUTHENTICITY

Commodore Coins & Collectibles, Ltd. guarantees that all uncertified or “raw” coins sold on its website are genuine and authentic. If any coin is determined to be counterfeit, a full refund will be issued, provided the coin is returned within 30 days of purchase in its original unaltered state and packaging and accompanied by proof from a recognized third-party coin grading service that the coin is not genuine. Buyer is responsible for any coin grading fees and all shipping costs. We cannot guarantee that paper certificates of authenticity (COA’s) or 2” x 2” paper inserts in plastic coin flips that accompany uncertified coins from certain shipwrecks are original as certain shipwrecks such as the Nuestra Señora de Atocha, the 1715 Spanish Fleet, and other wrecks had numerous types and styles of certificates of authentication issued over the years by numerous parties associated with their recovery and salvage. If a COA is deemed counterfeit by a recognized expert in these types of COA’s, we will issue buyer a refund provided the coin and COA are returned within 30 days of purchase in their original unaltered state and packaging. There will be no refund after 30 days of purchase.

SECTION 6 – NON-WARRANTY OF COIN GRADES & CONDITION

Commodore Coins & Collectibles, Ltd. does its best to describe each coin in detail and provides clear close-up photographs of the coin’s appearance, as well as weight in grams for certain coins such as Spanish or Spanish Colonial cobs. It is the buyer’s responsibility to request additional photos or information if needed prior to making a purchase and we will be happy to accommodate. However, Commodore Coins & Collectibles, Ltd. makes no guarantees or representations regrading any numerical grade or condition of any coins for sale. Coin grading is an art, not an exact science, and therefore any opinions on grading may not agree with the opinion of others (including trained experts), and the same expert may not grade the same coin with the same grade at two different times, as grading standards change over time. Furthermore, countries outside the U.S. have differing numismatic grading scales and standards that often do not correspond with or recognize U.S. standards or numerical levels of preservation. Coins that may not attain a numerical grade by U.S. numismatic grading standards often sell in foreign countries with little to no reduction in market value. In some cases, depending on rarity or provenance, certain coins can sell for far more outside the U.S. even though said coins may not attain a numerical grade by U.S. grading standards.

Most coins have some forms of contact marks, nicks, dings, scratches or hairline scratches, toning, or other surface conditions resulting from environmental exposure, circulation, use, previous preservation, etc. Some pieces (especially those salvaged from shipwrecks or found in the ground) may display corrosion, harsh cleaning, rust stains, pitting, horn silver deposits, or other forms of environmental effects. In addition, some coins may have been cleaned or conserved (either properly or improperly), placed in jewelry at some point, had the rims filed, had holes drilled in them or holes plugged, clipped in the past (where a slice of the coin was cut off) or otherwise had their original surfaces or design altered. All uncertified coins are sold as is and all sales on uncertified coins are final unless said item is deemed counterfeit or misidentified as to date, mint, or country of origin.

If a customer submits a misdescribed or over graded coin to a third-party coin certification service for authentication or grading and notifies Commodore of such submission within ten (10) days of the date of mailing or other delivery, we will continue to recognize a return privilege for thirty (30) days after customer’s receipt of said coin.

SECTION 7 – JEWELRY, ARTIFACTS & ANTIQUES

No returns will be accepted for any estate, antique or custom-made jewelry, artifacts, or antiques unless said item(s) are damaged in transit or deemed counterfeit. All sales on jewelry items, artifacts or antiques are final.

SECTION 8 – DAMAGED MERCHANDISE RETURNS

If you receive your order and the item(s) enclosed are found to be damaged in transit, we will issue a refund once the item(s) are returned. We will need to see a photo of the damages to the item(s) so we can properly handle your request. We will not be able to accept your claim for a damaged item beyond 15 days from the date you received the item(s). Buyer is responsible for shipping costs.

SECTION 9 – RETURNS POLICY & PROCEDURES

Returns are accepted only if post marked within 10 days of receipt of goods. All sales are final after 10 days. Returns will not be accepted on merchandise that has been altered or damaged after shipment. You are responsible for the return shipping and insurance costs. Please use a return shipping method that issues tracking numbers so you can ensure the item is safely and timely returned to our Returns Department. Shipping and handling charges are non-refundable. We reserve the right, at our sole discretion, to reject any return that does not comply with these requirements.

In order to properly process a return you must provide a detailed description of why you wish to return the item. We must then receive your acceptably returned order within 10 days from the date the item(s) were delivered. We recommend insuring your return package, as we cannot refund an item we don’t receive.

A returned item must be identical to the item description and condition of your original purchase.  Any item returned must be in the exact same condition in its original packaging without alterations, cleaning, scratches, blemishes, or any other sign of damages that did not exist prior to the sale.

SECTION 10 – PRODUCT DISPLAY & COLORS / ERRORS

Commodore Coins & Collectibles does its best to display product images shown on the site as accurately as possible. We cannot guarantee that the color you see will match the product color. The color of the product depends, partly upon the monitor you are using.

We reserve the right to cancel or void any sale without notice. Item(s) may be withdrawn at our discretion without prior notice. No Buyer shall have rights to any claim for any resulting damages against Commodore Coins & Collectibles, Ltd., its consignors, employees, officers and or related companies, for costs arising from either withdrawal of item(s), cancellation of purchase, loss or missing sale or reservation due to internet failure, server failure or website malfunction. All prices listed for items on this site are subject to change, and any prices posted in error may be corrected at any time. We are not responsible for typographical errors, technical problems and/or abnormal market fluctuations. We reserve the right to cancel any transaction at any time. Should a Buyer purchase a coin online which was incorrectly priced on the site, we reserve the right to void that transaction and offer the Buyer first option to purchase item at the corrected actual price. The descriptions for the item(s) used on this site are an arbitrary assessment by our staff. We shall not be held responsible for any third-party opinion or certification by any independent coin grading service(s). There is no explicit or inferred warranty by us for any items listed for sale with the exception that all items are authentic and genuine.

SECTION 11 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information may not be current and is provided for your reference only.

SECTION 12 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). In no case shall Commodore Coins & Collectibles, Ltd., our directors, officers, employees, affiliates, agents, contractors, consignors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. SECTION 18 – INDEMNIFICATION

SECTION 19 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 – DISPUTE RESOLUTION

This Agreement has been negotiated, executed, and delivered and shall be performed in San Diego, California and shall be governed by, construed and enforced in accordance with the laws of the State of California, without regard for its conflict of laws rules. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in San Diego, California, in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
